Breakly Upsell terms of service
Last updated October 23, 2026
These terms apply when a merchant installs and uses Breakly Upsell ("Breakly Upsell", "we", "us"), a Shopify app that shows one-click offers after checkout. By installing Breakly Upsell you accept these terms and our privacy policy.
The service#
Breakly Upsell shows your offers on Shopify's post-purchase page, where a buyer can add an item to the order they just paid for, and on the Thank you page for orders that skipped the post-purchase page, where a buyer can add the item to a new order with the offer's discount code. It needs a Shopify store with checkout extensibility, the Online Store channel and Breakly Upsell selected as the store's post-purchase app. Shopify decides which payments show the post-purchase page. If you turn on order tags in the app's Design page, Breakly Upsell also writes tags on the orders whose buyers accepted an upsell; Shopify asks you to let it edit orders first, and you can turn the tags off at any time. We can change, add or remove features; when a change removes something you use, we tell you in the app first.
Plans and billing#
- Shopify bills Breakly Upsell's plans on your Shopify invoice. The plans and what they include are on the Plan page in the app. Paid plans start with a free trial and can be paid monthly or yearly.
- A plan counts the upsells that buyers accepted on the post-purchase page in a month, each one on its own: an order whose buyer accepts two offers counts twice. Going over a plan never switches your offers off. If a month went over, changes to your offers are paused the next month until you move to a bigger plan or the month ends; you can still pause or delete offers and change the design and order tags.
- You can change plans in the app or stop paying by uninstalling Breakly Upsell. Charges and refunds follow Shopify's billing terms.
Charges to your buyers#
- When a buyer accepts an offer on the post-purchase page, Shopify adds the item to the order and charges the payment method of that order. Breakly Upsell never sees or stores payment details.
- Prices, discounts, shipping and taxes of an accepted offer are calculated by Shopify. Breakly Upsell shows the buyer the amount before they accept.
- Refunds, cancellations and returns of upsold items are handled in your Shopify admin like any other order line.
Your responsibilities#
- You choose your offers, their products, discounts, texts and conditions, and you make sure they follow the laws that apply to your store, such as rules on promotions, price reductions and post-purchase charges.
- Check new offers with a test order before you rely on them.
- Thank you page offers use a Shopify discount code that Breakly Upsell creates for each offer. You can see and edit it in Discounts; changing or deleting it there can stop the offer from working.
- Order tags are written only while you have them turned on. Tags already written stay on those orders when you turn tags off or uninstall Breakly Upsell; you can remove them in Orders.
- Don't use Breakly Upsell to break the law, to harm shoppers or to interfere with Shopify or with Breakly Upsell's servers.
How we process your store's data#
You control the personal data of your customers. Breakly Upsell processes it on your behalf, only to provide the app and only as your settings in the app direct.
- What and why: the data and the purposes are listed in the privacy policy. Breakly Upsell doesn't store shoppers' names, email addresses, phone numbers or postal addresses. The Thank you page block reads the buyer's email and shipping address only in the buyer's browser, to fill in the new checkout.
- Orders: with order tags on, Breakly Upsell reads each order whose buyer accepted an upsell, to check that the order holds the upsell, and writes its tags on it. Tagging changes nothing else in the order.
- Confidentiality: only the people who run Breakly Upsell can access the data, and only to operate and support the app.
- Security: data is encrypted in transit with TLS, and the database and its backups are stored on an encrypted volume. Access to the servers is limited to the people who run Breakly Upsell.
- Subprocessors: Shopify and our hosting provider. We tell you in the app before we add another.
- Requests: Breakly Upsell answers the customer data and erasure requests Shopify sends it, and we help you with other requests about data Breakly Upsell holds.
- Incidents: if we learn of a breach that affects your store's data, we tell you without undue delay.
- Deletion: when you uninstall, Breakly Upsell deletes your store's data after Shopify's store erasure request, about 48 hours later. Backups that contain it are overwritten within 14 days. The discount codes it created stay in your Discounts until they expire, at most 60 days later, and the tags it wrote stay on your orders.
Availability and support#
We work to keep Breakly Upsell running, but we don't guarantee that it is always available or free of errors. If Breakly Upsell's servers don't answer in time, the checkout continues without an offer; it never blocks a buyer's order. Support is by email at the address below.
Liability#
Breakly Upsell is provided as it is. To the extent the law allows, we aren't liable for indirect losses, such as lost profits or lost sales, and our total liability is limited to what you paid for Breakly Upsell in the 12 months before the claim. Nothing in these terms limits liability that the law doesn't allow to be limited.
Ending#
You can stop using Breakly Upsell at any time by uninstalling it. We can suspend or end your access if you break these terms or if the law requires it.
Changes and contact#
If these terms change, we update the date below and, for changes that affect you, tell you in the app before they apply.
